Bryter Sveriges regering och förvaltning mot lagar och normer i klimatnödläget?

Här diskuterar jag om Sveriges regering och förvaltning bryter mot internationella och nationella lagar och normer i det nuvarande klimatnödläget:

1. Stark evidens för ett klimatnödläge som kräver nationell och global mobilisering

  • Rockström  et al. (2020). “Climate tipping point – too risky to bet against” [23]
    p. 595:
    We argue that the intervention time left to prevent tipping could already have shrunk towards zero, whereas the reaction time to achieve net zero emissions is 30 years at best. Hence we might already have lost control of whether tipping happens. A saving grace is that the rate at which damage accumulates from tipping — and hence the risk posed — could still be under our control to some extent. The stability and resilience of our planet is in peril. International action — not just words — must reflect this.”

2. Bedömning av Sveriges klimatpolitik och nationell/Europeisk ansvar

  • Klimatpolitiska Radet i Rapport 2020 [12]:
    • “De klimatpolitiska målen bortom 2020 kommer inte att nås med nuvarande förutsättningar och beslutad politik.”
    • “Mycket talar för att Regeringskansliets beredningsrutiner inte räcker för att driva den nödvändiga omställningen med tillräcklig kraft och hastighet.”
    • “Den allvarligaste bristen är att regeringen inte redovisar i vilken grad de beslutade och aviserade insatserna i sina delar eller som helhet, bidrar till att klimatmålen kan nås. Därmed uppfyller inte handlingsplanen klimatlagens krav i detta avseende. Insatserna är därtill genomgående diffust beskrivna och saknar en tidplan för genomförande.”
    • “Klimatpolitiska rådet menar att regeringen bör utforma en permanent ordning där relevanta myndigheter – vilka dessa är kan variera över tid – får i uppdrag att fortlöpande föreslå beslut som bidrar till att Sverige når klimatmålen inom utsatt tid, inklusive konsekvensutredda förslag till klimatpolitiska handlingsplanen.”
    • “Kraften och förändringsviljan hos miljontals aktörer i hushåll, organisationer och mindre företag tas inte särskilt väl tillvara i regeringens samlade politik.”
    • “Handlingsplanen innehåller endast tre förslag som syftar till att bidra till jordbrukets omställning. … Regeringen förefaller här mer defensiv än själva branschen. LRF har nyligen antagit ett hållbarhetsprogram med målet att fasa ut fossila bränslen ur jordbrukets värdekedjor till 2035. Det är också olyckligt att regeringen nyligen förlängde de nedsättningar av koldioxid- och energiskatter som särskilt gäller för jord- och skogsbrukets arbetsmaskiner”.
  • Anderson. K. et al. (2020). “A factor of two: how the mitigation plans of ‘climate progressive’ nations fall far short of Paris-compliant pathways” [13]:
    • “The UK and Sweden propose annual mitigation rates of ∼5% whereas this analysis suggests, respectively, a minimum of 10% and 12% per annum.”
  • Hickel, J. (2020). “Quantifying national responsibility for climate breakdown: an equality-based attribution approach for carbon dioxide emissions in excess of the planetary boundary” [ 18]:
    • “This analysis proposes a novel method for quantifying national responsibility for damages related to climate change by looking at national contributions to cumulative CO2 emissions in excess of the planetary boundary of 350 ppm atmospheric CO2 concentration. This approach is rooted in the principle of equal per capita access to atmospheric commons. … As of 2015, the USA was responsible for 40% of excess global CO2 emissions. The European Union (EU-28) was responsible for 29%. The G8 nations (the USA, EU-28, Russia, Japan, and Canada) were together responsible for 85%. Countries classified by the UN Framework Convention on Climate Change as Annex I nations (ie, most industrialised countries) were responsible for 90% of excess emissions. The Global North was responsible for 92%. By contrast, most countries in the Global South were within their boundary fair shares, including India and China (although China will overshoot soon).”
    • Note: See the transient climate response to cumulative carbon emissions (TCRE) ratio which quantifies the linear relationship between cumulative carbon (greenhouse) gas emissions and increase of global temperature as the underlying rationale to use the cumulative (not the current) carbon emissions as a measure to derive national responsibility [19].
  • United Nations International Convention onthe Elimination of All Forms of Racial Discrimination on Sweden (2020). Opinion approved by the Committee under article 14 of the Convention concerning communication No. 54/2013 [24]
    • The Committee also recalls that where indigenous peoples have been deprived of lands and territories traditionally owned or otherwise inhabited or used without their free and informed consent, the State should take steps to return those lands and territories. “
    • The Committee observes that the State party admits that the decisions to grant mining concessions did not involve any considerations of the petitioners’ property rights(suprapara. 4.4).The Committee is of the view that the impossibility for obtaining an effectivejudicial review of a decision where the fundamental right of indigenous peoplesto traditional territory is being questioned is precisely a consequenceof treating indigenous communities as private land owners affected by the mining operations without due regard to the potential irreversibility of the consequences these operations may have on indigenous communities.

3. Nuvarande Internationella avtal

  • Paris Klimat Avtalet: “Sverige ratificerar klimatavtalet från Paris” [1]

  • WHO definition av barnmissbruk: “Child abuse or maltreatment constitutes all forms of physical and/or emotional ill-treatment, sexual abuse, neglect or negligent treatment or commercial or other exploitation, resulting in actual or potential harm to the child’s health, survival, development or dignity in the context of a relationship of responsibility, trust or power.” [2, 10]

4.Nuvarande nationella lagar och normer

  • Sveriges regeringsform: ”Det allmänna ska främja en hållbar utveckling som leder till en god miljö för nuvarande och kommande generationer.” [3, Kap 1, § 2, 3 st]
  • Diskrimineringslagen (2008:567): “direkt diskriminering: att någon missgynnas genom att behandlas sämre än någon annan behandlas, har behandlats eller skulle ha behandlats i en jämförbar situation, om missgynnandet har samband med kön, könsöverskridande identitet eller uttryck, etnisk tillhörighet, religion eller annan trosuppfattning, funktionsnedsättning, sexuell läggning eller ålder” [4, Kap 1, § 4 , st 1, 2].
    • Sverige diskriminerar barn och ungdomar eftersom de kommer att mycket mindre chanser att uppleva en intakt miljö och samma utvecklingsmöjligheter som nuvarande vuxna.
    • Sverige diskriminerar urfolket (Sami) och ger de inte rättigheter som Förenade Nationer kräver [24].
  • Statliga värdegrunden – gemensamma principer för en god förvaltning (dvs ledarskapets betydelse och rollen som statsanställd) [8, 9]
  • Allvarliga missförhållanden är brott med fängelse i straffskalan eller missförhållanden som liknar dessa. Enligt regeringen (prop. 2015/16:128, s. 35–47) bör bland annat följande kunna räknas som allvarliga missförhållanden: ekonomisk brottslighet, korrupta gärningar, handlingar som innebär risk för skador på miljön eller risker för människors liv och säkerhet, kränkningar av grundläggande fri­ och rättigheter, underlåtenhet att följa gällande föreskrifter samt brott mot interna regler och oetiska förhållanden. [11]

5. Framtida nationella lagar och normer

6. Motiv att bryta mot internationella och nationella lagar och normer

Sverige är en exportör av “fordon för vägar” och raffinerade “mineraloljor”, som var de två viktigaste exportvaror i 2018 [6]. Sverige köper råolja fran Ryssland och Norge (Nordsjön), raffinera den och säljer mineraloljan vidare [7]. De här faktorna kan vara relevanta att förklara varför den Svenska regeringen och förvaltningen har en motiv att bryta mot internationella och nationella lagar och normer för att få kortsiktiga politiska fördelar igenom att främja den Svenska ekonomin.

Motivet kan styrkas igenom att visa mot faktiska beslut och atgärder (tex utbyggnad av Arlanda, Preemraff, stöd av bilindustrin/VOLVO, aktieköp genom den Svenska regeringen  av SAS flybolaget efter privata aktieägare salde sina aktier i Corona pandemin) motverkar  atgärderna att följer Paris Klimat Avtalet.

7. Begränsingar av lagstiftningen

Lagar finns i olika statsformer oberoende om de är demokratisk, autokratisk eller följer ett annat system. I en demokrati far lagar sin legitimation genom demokratiska beslut, som följer principen att alla som rörs av ett lag ska ocksa ha rätt att paverka beslut. Avseende beslut som paverkar livsgrunder av framtida generationer (eller även människor i andra länder, särskilt i icke-demokratiska länder) betyder det att alla beslut som paverkar framtida generationer (eller  människor i andra länder, särskilt i icke-demokratiska länder) faktiskt inte fattas pa ett demokratisk sätt och saknar därför legimität. Man kan ju anta vilka beslut andra människor kommer att stödja, om information om deras beslut finns inte tillgängligt. Avseende framtida generationer kan man antar att de skulle inte stödja beslut som förstöra deras livsgrunder eller ha sa stor ressursförbrukning att det blir tydligen mindre kvar för de. Därför följer en icke-hallbar lagstiftning eller sadana regeringsbeslut inte den demokratiska principen och maste därför inte beaktas [14]. Annars skulle det betyder att lagstiftingen beslutas av en diktatur av den levande generation (en minoritet) bestämmer livsgrunder av framtida generationer (en majoritet) som kan inte paverka eller göra om besluten som har tagits.

Den rättspositivistiska uppfattningen säger att det finns ingen universell moral som är relevant för lagstiftningen [15] och lagar gäller oberoende av moral. Dock kan man försvara brott mot existerande lagar genom att använder Radbruch’s formel [16], om lagstiftningen avviker tydligen fran vad man anser som rättvist.

Problemet att folk förstar den här argumentationslinjan avseende det moraliska problemet  med hänsyn till hallbarhetsfragor är att den ligger utanför de konventionella ramarna av samhället och kräver post-konventionella moraliska perspektiven som användar abstrakta principer (tex “Man fa inte förstöra biosfären.”) i stället av lagar och normer som beror pa sociala värderingar av en majoritet av den nuvarande generation  (cf “Stages of Moral Development” model by Kohlberg [17]). Dvs att även om hela den nuvarande generationen stämmer överens att det är lagligt och rättvist att förbruka alla ressurser och förstöra livsgrunder för framtida generationer är det ända moraliskt fel (dvs ont).

8.  Relaterade rätteganger

Cox (2012) [25] describes the role of the legal system from a general international perspective and discusses examples of legal battles for climate justice.

In this illuminating book, attorney and pragmatic visionary Roger Cox sets out and analyzes these energy stress tests, going on to explain why neither the market mechanism nor today’s political model are capable of initiating an energy revolution to solve these issues. This deadlock situation has the potential to bring about the very downfall of Western society, as this book explains, and will at the very least put Western countries at risk of committing domestic human rights violations on a scale nobody had thought to ever see again after World War II. Precisely this threat of human rights violations puts the judiciary in a position to step in and lead Western governments out of the dangerous deadlock. Drawing and expanding on examples and cases from the US, the UK, the Netherlands, Europe and the European Union, this book demonstrates that the West’s legal systems already contain all the elements needed to achieve an energy revolution faster and more effectively then any other alternative.
